1. Introduction
3FO (“we,” “our,” “us”) respects the intellectual property rights of others and expects all users of our platform and services to do the same.
In compliance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), this policy describes the process for submitting notices of alleged copyright infringement and counter-notifications for the restoration of removed content.
As an internet service provider,Affiliate Marketing 3.0 DAO LLCis entitled to the “safe harbor” protections under the DMCA, provided that it responds in good faith to valid infringement notifications.
2. Notice of Infringement (Claim Procedure)
If you believe that content hosted, shared, or distributed through 3FO infringes your copyright, you may submit a DMCA Takedown Noticeto our designated agent.
To be valid under 17 U.S.C. §512(c)(3), your notification must include the following:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
Identification of the infringing material to be removed or disabled, along with information sufficient to locate it (e.g., URL or content ID).
Your contact details, including name, address, email, and telephone number.
A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner. .
3. False or Misleading Claims
Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents information in a DMCA notice may be liable for damages, including costs and attorney’s fees.
3FO strictly prohibits misuse of the DMCA process and reserves the right to seek legal recourse for fraudulent, abusive, or bad-faith submissions.
4. Counter Notification (Restoration Request)
If you believe that your material was removed or disabled by mistake or misidentification, you may file aCounter Notification under 17 U.S.C. §512(g)(3).
Your counter notice must include:
Your physical or electronic signature.
A description of the removed material and its location before removal (e.g., URL).
A statement, under penalty of perjury, that you have a good faith belief the content was removed due to an error or misidentification.
Your name, address, and phone number, along with a statement consenting to the jurisdiction of the Federal District Court for your judicial district (or, if outside the U.S., any jurisdiction where Affiliate Marketing 3.0 DAO LLC may be found).
A statement agreeing to accept service of process from the party who submitted the original DMCA notice.
Counter notifications must be sent to the same DMCA agent listed above.
Upon receiving a valid counter notice, 3FO may restore the removed content unless the original complainant initiates legal action within the timeframe allowed by law.
5. Repeat Infringer Policy
3FO enforces a strict zero-tolerance policy for repeated copyright violations. Users identified as repeat infringers may have their access permanently suspended or terminated.
Affiliate Marketing 3.0 DAO LLC maintains an internal record of valid DMCA notices to ensure consistent enforcement and compliance with U.S. copyright law.
6. Content Monitoring and Removal
While 3FO operates as a decentralized affiliate operating system, it reserves the right to remove or restrict access to any content hosted or linked through its ecosystem — including but not limited to dashboards, media materials, branding assets, marketing creatives, and user-generated submissions — upon receiving valid DMCA notices.
We also reserve the right to act against misuse of 3FO trademarks, branding, or proprietary materials across affiliated or third-party platforms.
7. Sharing of Claim Information
By submitting a DMCA notice, you acknowledge and agree that 3FO may share your notice, including personal contact details, with the user who allegedly infringed your copyright, as required by the DMCA’s counter-notification process.
This information sharing is a standard compliance requirement under U.S. law.
8. Modifications to This Policy
3FO reserves the right to revise or update this DMCA Policy at any time, without prior notice. All changes will be published on this page with an updated Effective Date.
